=============================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences under Sections 188 and 290 of the Indian Penal Code and Sections 30 (a) and 30(F) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 32 litres of country made liquor was recovered from the dickey of the vehicle which was being boarded by two persons including the petitioner and the petitioner is said to be the

Patna High Court Cr.Misc. No.53407 of 2017(2) dt.09-11-2017 2/2 driver of the said vehicle. Petitioner claims that he is having clean antecedent and is in custody since 15.08.2017.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Bhagalpur in connection with Sanokhar P.S. Case No. 128 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
