The petitioner, already in custody, seeks bail in connection with Madhepura (Ghailadh) P.S.Case No. 61 of 2018 registered under Sections 201,302 and 364/34 of the Indian penal Code.
Allegation in brief is that informant's brother went to market along with the petitioner thereafter became traceless and later on, petitioner confessed before the police that they have killed his brother..
Submission is that there is no recovery of dead body of the deceased and except so-called confessional statement of the petitioner made before the police there is no other material rather during investigation, it transpired that deceased had illicit
Patna High Court Cr.Misc. No.45567 of 2018(2) dt.31-07-2018 2/2 affair with the wife of Bhupendra Tanti and both were doing business to purchase and sell of cattles and on account of that, he had killed the deceased and the cloth of the deceased was recovered from the cattle shed of Bhupendra Tanti and the petitioner has no criminal antecedent and has been in custody since 08.02.32018 and investigation has been completed. Having considered the aforesaid facts and circumstances, the petitioner, namely, Santosh Kumar @ Santosh Tanti, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Madhepura in connection with Madhepura (Ghailadh OP) P.S.
