Petitioner seeks bail in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code.

Three persons including the petitioner were caught on the spot when they were travelling on a motorcycle. The police suspected that they were going to commit dacoity. A firearm was recovered and the motorcycle was found to be a stolen property. Petitioner is in custody since 24.05.2015. Submission is that trial has not concluded as yet and two other co-accused have already been allowed bail by a Coordinate Bench of this Court vide order dated 02.02.2016 passed in Cr. Misc. No. 3214 of 2016.

No.45516 of 2018 (2) dt.02-08-2018 2/2 Considering the nature of allegation and period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barhariya Police Station Case No. 156 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
