JUSTICE ARUN KUMAR ORAL ORDER 29-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Halsi PS Case No. 37 of 2017 registered under Sections 341, 323, 504, 307/34 of the IPC and Section 27 of the Arms Act.
The allegation in brief is that the petitioner shot at the informant's son in his chest causing fire arm injury. Learned Counsel for the petitioner submits that the said act was committed due to grave provocation as the injured used to talk with his wife and even after scolding him for that he used to do that. Having considered the specific allegation of causing fire arm injury on the chest of the informant's son causing grievous injury the prayer for bail of the petitioner is rejected.
