The petitioner seeks bail in Udwant Nagar P.S. Case No. 367 of 2018, instituted for the offence under Section(s) 392 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery of any incriminating article from conscious possession of the petitioner. No Test Identification Parade has been held. It is mentioned in the impugned order that on the disclosure made by the petitioner and other accused persons, eight Motorcycles have been recovered including the Motorcycle of the informant as mentioned in the instant case. Patna High Court CR. MISC. No.16838 of 2019(2) dt.27-03-2019 2/2 mentioned in paragraph-9 of the bail petition that separate case has been registered by the Police vide Udwant Nagar P.S. Case No. 371 of 2018.
Petitioner is in custody since 11.10.2018.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Udwant Nagar P.S.
