JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 16-08-2017 Delay of 20 days in filing of this appeal is condoned. I.A. No. 5849 of 2016 stands allowed and disposed of. Seeking exception to an order dated 30th of March, 2016 passed by the learned Writ Court in C.W.J.C. No. 13569 of 2015, this appeal has been filed by the appellant under Clause 10 of the Letters Patent.

In the matter of appointment on the post of Executive Assistant on contract basis based on a selection process conducted by the Collectorate, Gaya the learned Writ Court refused to interfere into the matter of fixing the minimum bench mark of 33 per cent primarily

Patna High Court LPA No.1241 of 2016 dt.16-08-2017 3/3 on account of the fact that there is no error in fixing the bench-mark and also after considering the fact that the appointment was on contract basis for a temporary period.

Having considered the contentions advanced, we see no reason to make any interference into the matter. The Letters Patent Appeal is dismissed.
