2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 103(1), 3(5) and 351(2) of BNS.
3. The case of the prosecution is that the petitioner along with others has killed the son of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that from perusal of the FIR itself, it is clear that the informant is not the eye witness of the alleged occurrence and the petitioner is only the prime suspect. During course of investigation, it was found that the tower location of the mobile of this petitioner was found at that place. Regarding this, learned counsel has submitted that he is the
Patna High Court CR. MISC. No.16906 of 2026(2) dt.16-04-2026 2/2 resident of that village and the tower location of his mobile is bound to be there and this should not be leading to any suspicion. It has further been submitted that similarly situated co-accused Rohit Kumar has been granted bail by learned co-ordinate Bench of this Court vide Cr. Misc. No. 73487 of 2025. The case of this petitioner stands on similar footing. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 03.06.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Manikpur P.S. Case No. 94 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-III, Lakhisarai.
