JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2017 The petitioner seeks regular bail in connection with Laxmipur P.S. Case No. 115 of 2017, registered for offences punishable under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. Police on information that some persons have assembled at a place to commit a crime, raided the place and from possession of the petitioner one country made loaded pistol along with one cartridge were recovered.

Submission of learned counsel for the petitioner that he has falsely been implicated in this case at the instance of police and in fact nothing has been recovered from his possession and though he is accused in one more case but he has been made accused in that case after arrest in this case. Further he has been in

Patna High Court Cr.Misc. No.55108 of 2017 (3) dt.22-11-2017 2/3 custody since 25.06.2017.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jamui, in connection with Laxmipur P.S. Case No. 115 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner shall mark his attendance in the local police station of his area in the first week of each months at least for a period of one year so that the police may watch his conduct during that period.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates

Patna High Court Cr.Misc. No.55108 of 2017 (3) dt.22-11-2017 3/3 without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.

Let a copy of this order be communicated to the S.P. of concerned district so as to ensure the compliance of above direction by the petitioner.
