The petitioner seeks bail in a case instituted for the offences under Sections 356, 379/34 of the Indian Penal Code.. The prosecution case in short is that the accused persons snatched the mobile phone and a golden chain of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.12.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R.. The name of the petitioner has come on the basis of

Patna High Court CR. MISC. No.21257 of 2019(2) dt.12-04-2019 2/2 confessional statement of co-accused. It is further submitted that the petitioner is ready to deposit a sum of Rs. 10,000/- in the court below which shall be subject to the final disposal of the case.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R..

Considering the aforesaid facts and circumstances, on deposit of a sum of Rs. 10,000/- in the Court below which shall be subject to final disposal of the cas e , it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Civil Lines P.S. Case No. 385/2018.
