The petitioner is in judicial custody in connection with Bathnaha P.S. Case No. 181 of 2021 for the offences under Section 392 of the Indian Penal Code.

As per the FIR, on 22.07.2021 when the informant was going to Sonbarsa from Samastipur, it is alleged that the named accused persons including the petitioner herein put revolver on his head and after assaulting him decamped with Rs. 1,11,000/- along with the mobile. Accordingly, the FIR was lodged and the petitioner has been taken into custody. Learned counsel for the petitioner submits that he is in

Patna High Court CR. MISC. No.18178 of 2022(4) dt.17-08-2022 2/2 bail in most of the cases and he has been implicated by the police due to his criminal antecedent.

Learned APP for the State, on the other hand, submits that a bare perusal of the paragraph-3 of the bail application shows that he has sixteen (16) criminal cases of the same nature lodged against him and as such allowing him on bail is once again lead to some more occurrence in future and in nutshell opposed the prayer.

Considering the nature of the allegation of assault and looting of Rs. 1,11,000/- as also that 16 criminal cases are registered against him of the same nature, this Court for the present is not inclined to grant him the privilege of bail, which is accordingly rejected.
