JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2017 The petitioner is apprehending his arrest in connection with Complaint Case No. 115C of 2044, registered for offences punishable under Section 498(A) of the Indian Penal Code. In this case from order dated 13.12.2016, it appears that the parties had earlier prayed for adjournment to examine the possibility of settlement of dispute between the parties. However no settlement could be reached.
It has been submitted on behalf of the petitioner that the petitioner is still ready to keep his wife with full honour and dignity.
Heard learned A.P.P. and learned counsel appearing on behalf of opposite party no. 2 also.
Patna High Court Cr.Misc. No.24342 of 2016 (5) dt.23-01-2017 2/2 In view of the submission of learned counsel for the parties, let petitioner surrender before the Court below by 15.02.2017, on which date the complainant shall also present herself and learned Court below shall find out from them as to whether there is any chance of compromise/amicable settlement between the parties and as to whether they can live happily with each other, thereafter, learned Court below shall pass an appropriate order on the basis of the materials available before him at that point of time.
In the meanwhile and until orders passed by learned Court below, let no coercive steps be taken against the petitioner. With the above observation, this application is disposed of.
