In this case, the petitioners are seeking regular bail in connection with Bhawanipur P.S. Case No. 02 of 2016, registered for the offence under Sections 341, 323, 448 and 307/34 of the Indian Penal Code. Later on, Section 302 of the Indian Penal Code was also added as the victim has died. Allegation has been made against the petitioners and other family members that they have assaulted the wife of the informant with lathi and danda, as a result of which, she sustained grievous injury and ultimately died. In paragraph nos. 13,14, 15 and 16 of the case
Patna High Court CR. MISC. No.15829 of 2020(5) dt.26-11-2020 2/2 diary, it has been stated that two groups of female were quarreling with each other and when the wife of the informant tried to specify them, in which she received injury on her had and ultimately she died.
Learned counsel for the petitioners submits that the allegations made against the petitioners are general and omnibus and no specific allegation has been made against the petitioners, inasmuch as, the petitioners are in custody since 05.12.2019. Considering the aforesaid facts and circumstances of the case, let the petitioners, above-named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Purnea, in connection with Bhawanipur P.S. Case No. 02 of 2016, subject to the condition that the petitioners would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioners.
