2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 323, 307, 302/504 of the Indian Penal Code.
3. It is alleged that this petitioner along with other coaccused persons assaulted the informant and his family members, as a result of which, informant's wife sustained injuries thereafter she was taken to the hospital where she died.
4. As per F.I.R, petitioner is not the assailant of the informant's wife (deceased). It was co-accused Chulla Devi, Khushboo Devi and Ponam Devi, who assaulted the deceased. Similarly situated co-accused persons have already granted bail
Patna High Court CR. MISC. No.20598 of 2023(3) dt.28-07-2023 2/2 by this Court vide order dated 04.03.2023 in Cr. Misc. No. 1122 of 2023. Petitioners claim clean antecedent.
5. Learned counsel for the State and informant vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Pipariya P.S. case no 64 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
