Petitioner prays for bail in connection with Sahar P.S.Case No. 78 of 2018 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code. Allegation against the petitioner is that he has not handed over the charge to his successor.
Submission of learned counsel for the petitioner is that there is no allegation of defalcation or misappropriation against the petitioner and he is in custody since 19.5.2018 and once he is out of jail custody he will handover the charge. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail
Patna High Court Cr.Misc. No.46171 of 2018 (2) dt.13-09-2018 2/2 on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-X, Bhojpur at Ara, in connection with Sahar P.S.Case No. 78 of 2018, subject to the that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that he will handover the charge after coming out of the jail, otherwise prosecution will be at liberty to move for cancellation of his bail bond in the court below itself.
