This is a case of misuse of bail. The petitioner, who is an accused of Khushrupur P.S. Case No. 40/99 dated 29.04.1999 instituted for the offences under Sections 498A, 494, 307/34 of the Indian Penal and Section 3/4 of the Dowry Prohibition Act, was granted bail way back on 30.01.2002. The petitioner happens to be elder brother of the husband of the victim. Since there was a compromise in the matter, the petitioner, perhaps, thought that he was not required to be present in court. As such, his bail bond was cancelled on 05.06.2008.

The petitioner is now in custody since 19.05.2017. Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner.

Patna High Court Cr.Misc. No.51414 of 2017 (4) dt.29-11-2017 2/2 released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. I, Patna City in connection with Khushrupur P.S. Case No. 40/99, corresponding to S.Tr. No. 272/2000.

However, it is made clear that the petitioner shall participate in the trial and his unauthorized absence from the trial for two consecutive dates would entitle the State to proceed for cancellation of bail granted to the petitioner. (Ashutosh Kumar, J.) Rakhi U T
