JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a of the Bihar Prohibition and Excise Act.

As per the prosecution case, huge quantity of illegal liquor was recovered from the vehicle of which petitioner is the registered owner.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he had no knowledge of the consignment being transported through his vehicle. Learned counsel appearing for the State opposes the prayer for bail and submits that petitioner is the registered owner of the vehicle which was used in transportation of illegal

Patna High Court CR. MISC. No.20634 of 2023(3) dt.19-06-2023 2/2 liquor as such he cannot escape responsibility. Considering the aforesaid fact, prayer for bail of the petitioner is refused.
