The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 406 of the Indian Penal Code and 3/4 of the S.C./S.T.(Prevention of Atrocities) Act.

The prosecution case is that the informant agree to purchase land from the petitioner appertaining to khata no. 117, plot no. 194, area 16 1⁄2 decimals for consideration amount of Rs. 10,00,000/-, out of which Rs. 8,51,000/- was paid. But subsequently, neither money was returned nor land has been transferred in the name of the informant.

It is submitted by the learned counsel for the petitioner that there is no proof with regard to payment. In the agreement paper considerable amount and area is to be filled up but is still blank. Statement has been made in

Patna High Court Cr.Misc. No.24537 of 2016 (2) dt.31-05-2016 para-3 of the petition that petitioner has no criminal antecedent.

Considering the nature of accusation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Mansahi P.S. Case No. 12 of 2016, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
