JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-01-2018 This case has been taken out of turn as the petitioner is an examinee of Intermediate examination which is scheduled from 11.01.2018. A supplementary affidavit to that effect has been filed today. Let it be kept on record. Heard the counsels for the parties.

The petitioner seeks bail in connection with Jakkanpur P.S. Case No. 26 of 2017 dated 30.01.2017 instituted for the offence under Section 379 of the Indian Penal Code. The motorcycle of the informant was stolen away. The petitioner was arrested on the basis of the statement made by a co-accused in another case viz. Jehanabad P.S. Case No. 58 of 2017 which was instituted for the offences under Sections 413 and 414 of the Indian Penal Code. From the

Patna High Court Cr.Misc. No.59737 of 2017 (3) dt.08-01-2018 2/2 aforesaid case, the petitioner was remanded to Beur P.S. Case No. 33 of 2017 for the offence under Section 379 of the Indian Penal Code. Thereafter, the petitioner has been remanded in two other cases including the present case in which the petitioner seeks bail. In Jehanabad P.S. Case No. 58 of 2017, the petitioner has been granted bail. Nothing has been recovered from the possession of the petitioner. The petitioner is in custody since 30.08.2017. Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Patna in connection with Jakkanpur P.S.
