2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Raniganj P.S. Case no. 229 of 2023 instituted for the offence under Sections 302, 147, 341, 323/34 of the Indian Penal Code.

3. It is a case of murder of informant' son. Allegation against the petitioners is of indulging in hatching conspiracy

Patna High Court CR. MISC. No.20048 of 2024(3) dt.26-04-2024 2/3 to kill the informant's son Ajit Kumar in connivance with others.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. From perusal of FIR, no specific overtact attributed against the petitioners. The case has been lodged only on the basis of suspicion. No any eye witnesses to the alleged occurrence. Other co-accused Radha Devi and Rajmani Devi have already been granted bail by this Court vide order dt. 5.1.2024 passed in Cr. Misc. No. 65835 of 2023. The petitioners have got no criminal antecedents.

5. Learned APP appearing for the state has opposed the prayer of bail.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Raniganj P.S. Case no. 229 of 2023, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
