Informant, wife of deceased, filed a written report one month and six days after the alleged occurrence putting omnibus allegation of assault by rod, Farsa against altogether ten persons including the petitioner. It is further evident that the deceased was taken to PMCH having been referred by the concerned hospital where his statement was recorded on 02.04.2019 (part of the written report) carrying same and similar allegation. Co-accused, Sk. Amir has already been granted bail under Cr.Misc. No. 74685/2019 vide order dated 04.12.2019 by a Co-ordinate Bench of this Court whereunder the cause of death has been shown as tuberculosis. From the postmortem report, ( Annexure-4) , the finding is found duly substantiated.

Patna High Court CR. MISC. No.15812 of 2020(2) dt.04-06-2020 2/2 Petitioner is under custody since 28.08.2019. Accordingly, petitioner, SK MANEER is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah in connection with Majhauliya PS Case No. 195/2019.
