JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Nardiganj Police Station Case No. 125 of 2015 registered for the offences punishable under Sections 341, 379, 353, 385, 504, 506 of the Indian Penal Code.

Taking into consideration that petitioner is one of the named accused in the first information report in which there is allegation against the petitioner that he also participated in the alleged crime, I am not inclined to extend the privilege of anticipatory bail to the petitioner and, accordingly, his prayer for anticipatory bail in connection with Nardiganj P.S.Case No. 125 of 2015 pending in the court of Sub-Divisional Judicial

Patna High Court Cr.Misc. No.24916 of 2016 (2) dt.16-06-2016 2/2 Magistrate, Nawada stands rejected.

However, it is made clear that if petitioner surrenders and seeks regular bail within four weeks from the date of receipt/ production of a copy of this order in the court below, the concerned court shall consider regular bail application of the petitioner on its own merit without being prejudiced by this rejection order, particularly keeping in mind that no specific allegation has been levelled against the petitioner.
