JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379 of the Indian Penal Code.

The prosecution case is that the ATM of the informant went missing on 08.07.2015 and next day Rs. 26,000/- was withdrawn from his account.

It is submitted by learned counsel for the petitioner that informant gave the ATM card to withdraw the money which was withdrawn by the petitioner and handed over to the informant.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Kotwali P.S. Case No. 418 of 2014, G.R. No. 4180 of 2014,

Patna High Court Cr.Misc. No.24506 of 2016 (2) dt.31-05-2016 2/2 pending in the Court of learned Chief Judicial Magistrate, Patna.

It is expected from the learned Court below to dispose of the regular bail of the petitioner preferably on the same day.

With the observations above, the application stands disposed off.
