JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-05-2019 The petitioner seeks regular bail in connection with Chapra Rail P.S. Case No. 129 of 2018, registered for offences punishable under Sections 394 of the Indian Penal Code. Allegation as per F.I.R. is that while the informant and others were returning after completion of work on railway track, two persons came out from the bushes and snatched away the articles from the informant his colleague and also attacked on the abdomen with knife. Apart from that petitioner is accused in six other cases.

It has been submitted on behalf of the petitioner that the F.I.R. has been registered against unknown and save and except the confessional statement of co-accused, there is nothing against the petitioner to show his involvement in this case and further he has been in judicial custody since

Patna High Court CR. MISC. No.17670 of 2019(3) dt.20-05-2019 2/2 07.09.2018 and co-accused having similar allegation has already been enlarged on bail vide order dated 06.12.2018 passed by this Court in Cr. Misc. No. 70143 of 2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, (Railway), Saran at Chapra, in connection with Chapra Rail P.S. Case No. 129 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
