This matter was heard and after considering the submissions advanced on behalf of the parties the Court granted liberty to the respondents on the issue of willingness to pay the post retiral dues on the condition of furnishing bank guarantee or 9% compound interest on the final outcome of LPA No. 1159 of 2019.

Mr. Harish Kumar, learned Government Pleader No. 8 submits on instruction that respondents will make payment of

Patna High Court CWJC No.5973 of 2020(4) dt.14-09-2020 2/2 post retiral dues subject to furnishing bank guarantee and the final outcome of LPA No. 1157 of 2019.

In view of the above, the writ petition is disposed of with a direction to the respondents to ensure payment of entire post retiral dues at the earliest preferably within 60 days from the date of receipt/production of a copy of this order on furnishing bank guarantee and on the clear understanding that payment shall abide by the final outcome of LPA No. 1157 of 2019.
