JUSTICE ARUN KUMAR ORAL ORDER 24-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Kalyanpur PS Case No. 34 of 2017 registered under Sections 8, 20(b)(ii)(B), 22, 25 and 29 of the NDPS Act.
The allegation in brief is that 2 Quintal and 43 Kilograms Ganja was recovered from the truck of the petitioner. Submission is that some other persons were loading the contraband on a tempo and this petitioner was also apprehended on suspicion. He is in custody since 16.3.2017.
Learned Counsel for the State submits that 2 Quintal 43 Kilogram of Ganja was recovered from the truck of the petitioner and some other contraband were also being unloaded from the truck on a tempo and from that also 15 Kilogram of Ganja was recovered. Having considered the said facts, circumstances and recovery of huge quantity of Ganja, the prayer for bail of the petitioner is rejected.
The trial court is directed to expedite the trial and preferably conclude the same within two years.
