The petitioner is in custody since 26.03.2018 in connection with Giriyak P.S. Case No. 117 of 2018 for the offence registered under Sections 461, 379, 411 of the Indian Penal Code and Section 25(1-b)a/26 and 35 of the Arms Act. Learned counsel for the petitioner submits that though it is alleged that the petitioner was arrested from the place of occurrence, the petitioner is wholly innocent and has falsely been implicated in connection with the present case. It is further submitted that three other similarly situated co-accused persons namely, Lal Chand Vishwakarma Rajesh Mistry and Vikash Kumar have since been extended the privilege of bail in

Patna High Court Cr.Misc. No.46313 of 2018 (2) dt.29-08-2018 connection with the present case passed in Cr. Misc. No. 34459 vide order dated 02.08.2018, in Cr. Misc. No. 32740 of 2018 vide order dated 12.06.2018 and also in Cr. Misc. No. 34112 of 2018 vide order dated 13.06.2018.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-I, Nalanda at Biharsharif in connection with Giriyak P.S.
