In this case, the petitioner is seeking anticipatory bail in connection with Bhagwan Bazar P.S. Case No. 528 of 2017, registered for the offence under Section 379 of the Indian Penal Code.

A stolen Motorcycle bearing registration no. BRO 4G-4157 was intercepted and recovered from the possession of one Prakash Kumar Prasad, who has disclosed that he along with the present petitioner had stolen the motorcycle. Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays

Patna High Court CR. MISC. No.17415 of 2019(2) dt.28-03-2019 2/2 for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
