The petitioner apprehends his arrest for the offences punishable under Section 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

It is submitted on behalf of the petitioner that he was kidnapped by the complainant's father on 25.02.2013 for which F.I.R. was also lodged by the mother of the petitioner. In that case, after recovery of the petitioner, his statement was also recorded under Section 164 of the Cr.P.C. in which he had stated that on the gun point he was forced to sit besides the complainant and photographs were taken. Thereafter, the petitioner had married a girl and after more than one year from the date of the aforesaid occurrence present complaint case has been filed under Section

Patna High Court Cr.Misc. No.36925 of 2014 (2) dt.20-02-2015 2 / 2 498(A) of the I.P.C. whereas the fact is that no marriage was solemnized between the petitioner and the complainant. Having regard to the facts and circumstances of the case, let the petitioner, namely, Pawan Kumar be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Complaint Case No.CI-111/14, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
