JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 467/34 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.
The prosecution case is that the accused persons came to the house of the informant and assaulted the informant. It is alleged that petitioner assaulted with bamboo stick on the head of the informant and when the informant fell down then other accused persons assaulted the informant. It is also alleged against the petitioner that he forcibly took signature of the informant on the blank paper. It is submitted by learned counsel for the petitioner that in the background of the litigated relationship with his neighbour Nishkant Kumar Singh and Murlidhar Singh, they managed the informant to lodge the frivolous case against the petitioner as informant is under raiyat of Nishkant Kumar Singh and Murlidhar Singh. Patna High Court Cr.Misc. No.24524 of 2016 (2) dt.31-05-2016 2/2 inside the house, hence it can not be treated to be in public view.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Sitamarhi SC/ST P.S. Case No. 88 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, Sitamarhi.
With the observations above, the application stands disposed off.
