JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2018 Earlier prayer for bail of the petitioner was rejected on merit vide order dated 28.03.2017 passed in Cr. Misc. No. 13054 of 2017 with direction to the court below to conclude the trial as soon as possible.
Earlier a report was called for from which it appears that already four witnesses have been examined and case is pending for examination of three witnesses.
Submission of learned counsel for the petitioner that earlier, there was no progress in the trial, the present application was filed and petitioner has been in judicial custody since 02.10.2016. Considering the facts and circumstances of the case and as the prayer of bail of the petitioner has already been rejected on
Patna High Court Cr.Misc. No.54798 of 2017 (4) dt.10-01-2018 2/2 merit, I am not inclined to release the petitioner on bail. However, since the petitioner is in custody since long, trial court is directed to conclude the trial within a reasonable time. With the aforesaid observation, this application is dismissed.
