The petitioner is in custody since 18.05.2018, in connection with Barun P.S. Case No. 97 of 2018, for the offence registered under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 395, 436, 504, 120B of the I.P.C., and 3⁄4 Prevention of damage of Public Property Act.
Learned counsel for the petitioner submits that he has been named in the present FIR as he was part of the assembly which had gathered at the road side for resisting the action of the police who was not taking action against the road accident case.
It is further submitted that no overt act has been attributed to the petitioner and he is a man clean antecedent. It
Patna High Court Cr.Misc. No.46032 of 2018(2) dt.14-08-2018 2/2 is further submitted that similarly situated co-accused who were also part of the assembly have been granted bail by various coordinate benches of this court.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No. 97 of 2018.
