This application is filed for grant of regular bail in connection with Excise P.S. Case No. 185 of 2023 (Special Case No. 1265 of 2023) registered under sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 100 litres of country made wine from a motorcycle. The petitioner is in custody since 03.02.2023 and he has clean antecedent.

Learned A.P.P. has vehemently opposed the prayer for

Patna High Court CR. MISC. No.19956 of 2023(2) dt.22-05-2023 2/2 bail.

Considering the period of custody and the nature of allegations levelled against the petitioner as well as the fact that he has clean antecedent, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna, District-Patna in connection with Excise P.S. Case No. 185 of 2023 (Special Case No. 1265 of 2023).
