JUSTICE KISHORE KUMAR MANDAL ORAL JUDGMENT Date: 20-08-2015 Heard Mr. Naresh Dixit for the petitioner and Mr. Purushottam Jha for the respondent Bihar State Housing Cooperative Federation Limited ( for short 'the Federation'). This matter has been placed for consideration along with CWJC No. 7346 of 2004. The dispute between the parties relate to the invocation of the one time settlement scheme by the petitioner society. On account of non payment of the loan amount punitive actions appears to have been taken by the respondent- Federation leading to the filing of the present writ petition.

Patna High Court CWJC No.600 of 2012 dt.20-08-2015 2/2 Today I have disposed of CWJC No. 7346 of 2004 permitting the petitioner to ascertain in consultation with the respondent- Federation the actual loan amount payable by the petitioner society to the respondent- Federation as per the OTS scheme dated 20.2.2004 along with interest. This court has permitted four months time to comply with the order by paying the entire outstanding dues to the respondent- Federation. On doing so, the respondent- Federation has been directed to issue no objection certificate. In view of the aforesaid order in the said writ petition, the present application has lost its relevance. The only thing which requires to be done is to direct the respondent- Federation not take any further coercive action against the petitioner society for a period of four months from today.

The writ application is disposed of.
