The petitioner is accused in Belhar (Khesar) Police Station Case No 30 of 2016 registered for the offence punishable under Section 395 of Indian Penal Code.
Counsel for the petitioner submits that though it is alleged that confessional statement implicating the petitioner in the case of road hold up was made in the year, 2015 by one Abhishek Kumar Singh, he has been arrested much later on 05.08.2017. Till date, he has not been put on test identification parade nor has been identified by any other witness. Merely on the basis of suspicion, he is languishing in custody in connection with this case since 05.08.2017. The said Abhishek Kumar has

Having regard to the submissions made on behalf of the petitioner, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Banka in Belhar (Khesar) Police Station Case No 30 of 2015 subject to the following conditions:
(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
