Petitioners are apprehending their arrest in connection with Barbigha P.S. Case No. 98 of 2016 for offence under Sections 448, 323, 307 and 34 of the Indian Penal Code. The prosecution case is that the petitioners entered into the house of the Informant and demanded extortion from him and non-agreeing to make payment, the petitioners assaulted the Informant with iron rod on his head due to which the Informant become unconscious.

Learned counsel for the petitioners has submitted that for a petty dispute, accusation has been leveled against the petitioners and the injury caused to the Informant is simple in

Patna High Court Cr.Misc. No.23280 of 2016 (2) dt.24-05-2016 nature. A statement has been made in paragraph no.3 of this petition, that the petitioners have got no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Barbigha P.S. Case No. 98 of 2016, pending the court of Additional Chief Judicial Magistrate-II, Sheikhpura.

With the aforementioned observations, the application stands disposed of.
