This is an application seeking quashing of the FIR of Kazi Mohammadpur P.S. Case No. 316 of 2015 dated 13.07.2015 instituted for the offence under
Patna High Court CR. MISC. No.24985 of 2016(4) dt.19-01-2021 2/2 Sections 304/34 of the Indian Penal Code.
On 05.11.2020, this Court had called for a report about the stage of the case from the court below. The report indicates that the investigating officer has submitted final form in this case on 27.01.2016. Notice has been issued upon the informant on 08.04.2016. A protest petition also has been filed.
In this view of the matter, I am not inclined to entertain the present petition.
The petition is dismissed.
The petitioners shall have but the liberty to agitate before an appropriate forum, if the protest petition is moved and any order is passed against the petitioners.
The petition stands disposed of accordingly.
