Mr.Harendra Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-07-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Katoria P.S. Case no. 81 of 2015, registered under Sections 341, 323, 324, 325 and 307/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The accusation is that the marriage of the informant Sulochana Devi was performed with Kailash Yadav, son of the petitioners, before three years, while informant was kept six months properly, but thereafter she was being tortured by her husband and other in-laws due to non-fulfillment of demand of vehicle and cash. Thereafter, informant informed the incident to her father, who came and tried to pacify the matter and her father transferred half katha of land situated in Deoghar in the name of her husband Kailash Yadav and brother-in-law

Patna High Court CR. MISC. No.19260 of 2019(6) dt.25-07-2019 2/2 Harinandan Yadav, but they sold the said land and, again, they started giving pressure to transfer his remaining land. On protest, the informant was sent to her Myaka. Thereafter, the husband and brother in law of the informant came and took her in the forest, where her husband gave knife blow at her stomach and caused injury at her head.

Learned counsel for the petitioners submits that petitioners are father-in-law and mother-in-law of the informant and no any overt act has been attributed against them, except, the torturing of the informant. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-I, Banka in connection with Katoria P.S. Case No. 81 of 2015, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
