This is an application for bail in connection with Paraiya P.S.Case No. 81 of 2005 registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. Petitioner is not named in the FIR and later on his name transpires on the basis of information supplied by spy. Submission of learned counsel for the petitioner is that impugned order itself shows that except information supplied by spy there is absolutely nothing against the petitioner and he is in custody since 20.8.2017.

Heard learned APP also.

Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released

Patna High Court Cr.Misc. No.55195 of 2017 (2) dt.20-11-2017 2/2 on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Smt. Pratibha, Judicial Magistrate, 1st Class, Gaya, in connection with Paraiya P.S.Case No. 81 of 2005, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court, failing which his bail bond shall be cancelled.
