2. The petitioner is in custody in a case registered for the offence punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2018.
3. As per allegation in the FIR, total 1290 liters of illicit Nepalese country made wine was recovered in seventeen gunny bags from the hut of co-accused Devendra Thakur.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that nothing has been recovered from the conscious possession of the petitioner and the alleged liquor was recovered from the co-accused Devendra Thakur and petitioner has got
Patna High Court CR. MISC. No.17046 of 2025(3) dt.14-05-2025 2/2 clean antecedent as stated in para-3 of the petition and he is in custody since 21.02.2025.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. In view of the aforesaid facts and circumstances as also the fact that nothing has been recovered from the house, so I am inclined to grant regular bail to the petitioner.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Exclusive Excise Court-I, Sitamarhi in connection with Sonbersa P.S. Case No. 348 of 2023.
