The petitioner seeks bail in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

225 liters of Nepali Saufi wine has been recovered from a vehicle and this petitioner was apprehended on spot. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the said vehicle. Petitioner claims clean antecedent and he is in custody since 08.02.2022.

Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, clean antecedent

Patna High Court CR. MISC. No.18371 of 2022(2) dt.26-05-2022 2/2 and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Exclusive Special Excise Court - 1, Sitamarhi in connection with Kanhauli P.S. Case No. 18 of 2022.
