Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code.

Initially, the case was lodged under Section 304(B) of the Indian Penal Code on the statement of the father of the victim girl who is married with co-accused Siya Ram Bhagat. Petitioner is father-in-law. During investigation, it reveals that this was not a case of Section 304(B) rather a case of relationship between the deceased and the petitioner, when the father of the deceased reached at his house he saw the throat of his daughter cut.

Patna High Court Cr.Misc. No.52209 of 2017 (3) dt.02-01-2018 Learned counsel for the informant opposed the prayer for bail.

Petitioner is in custody since 18.06.2017.

Considering the fact that only circumstance above referred revealed against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Raghopur Police Station Case No.59 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
