The petitioner apprehends his arrest in connection with Banka P.S. Case No. 382 of 2010 for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, there is land dispute between the parties and on account of the same altogether six persons have been named in the F.I.R. including this petitioner on the basis of suspicion only. No specific allegation is attributed to the petitioner. Moreover, nothing

Patna High Court CR. MISC. No.19959 of 2019(4) dt.22-05-2019 2/2 specific has come against the petitioner in the case diary. Hence, the petitioner may be granted the privilege of anticipatory bail.

Learned counsel for the State has opposed the prayer for bail and submitted that the case is of the year 2010 and charge sheet in this case has already been submitted in the year 2013. Therefore the prayer for grant of anticipatory bail of this petitioner may be refused. Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail to this petitioner. Accordingly, the prayer for grant of anticipatory bail of this petitioner is rejected. The petitioner is directed to surrender before the court below within a period of two weeks from the date of this order.
