ANJANA MISHRA ORAL ORDER 05-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Thawe P.S. Case No.27 of 2015 for allegedly having committed the offence under Sections 406, 409, 417, 420/34 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

It is submitted on behalf of the petitioner that the owner of the rice mill in question has not supplied the proportionate rice to the Corporation, which has initiated the filing of the F.I.R.. However, the owner of the rice mill has been extended the benefit of anticipatory bail by this Court on the undertaking that he shall deposit 20% of the amount stated

Patna High Court Cr.Misc. No.29916 of 2015 (2) dt.05-08-2015 2/2 in the F.I.R. within a period of twelve months through Bank draft. It is submitted that the petitioner is the Operator of the concerned rice mill of which the owner has already been extended the privilege of anticipatory bail.

Considering the aforementioned submissions and also after taking into consideration the order dated 31.7.2015 passed in Cr.Misc. No.30084 of 2015, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Gopalganj, in connection with Thawe P.S. Case No.27 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
