Petitioner apprehends his arrest in connection with Shahpur P.S. Case No. 37 of 2016, registered for the offences punishable under Sections 25(1-b) A, 26, 35 of the Arms Act. The accusation against the petitioner is that one country made revolver and cartridges as well as six bottles of English liquor were recovered from his house.
Submissions on behalf of the petitioner is that the aforesaid recovery is nothing but only highhandedness of the Police and moreover, even if the prosecution story is assumed to be true, then also the said recovery was made available from joint house and therefore, no responsibility can be fixed solely upon the
Patna High Court Cr.Misc. No.24819 of 2016 (2) dt.15-06-2016 2/2 shoulder of the petitioner.
Regard being had to the facts and circumstances of the case as well as submissions of the parties, I do not fill it proper to extend the privilege of anticipatory bail to the petitioner and accordingly, this anticipatory bail petition stands rejected. However, this order would not cause prejudice to the concerned Court at the time of consideration of regular bail.
