JUSTICE DHARNIDHAR JHA ORAL ORDER 20-02-2015 Heard Sri Sumeet Kumar Singh, learned counsel appearing for the petitioner. None appears on behalf of the State. The learned Sessions Judge, Bhojpur at Ara has himself recorded that during the reconciliation proceeding taken up by him, the informant who happened to be the wife of the present petitioner refused to live with the petitioner. The attention of the court has also been drawn to Annexure-2 at page-19, filed a petition by the petitioner before the Incharge Superintendent, Mahila Help Line, Dehradoon, requesting the authorities to ensure the restitution of his conjugal rights by persuading the lady (informant) to come back into the association of the petitioner.

Regard being had to the facts and circumstances of the case, let the above named petitioner be released on bail either in

Patna High Court Cr.Misc. No.36130 of 2014 (2) dt.20-02-2015 the event of his arrest by the police or surrender before the court below on furnishing bail bond of Rs.5,000/-(five thousand) with two sureties of the like amount each to the satisfaction of CJM, Bhojpur at Ara in Mahila P.S.Case No.49 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
