JUSTICE SHIVAJI PANDEY ORAL ORDER 04-02-2015 It appears from the record that Manju Kumari and Yamuna Prasad, respondent no.7 have already appeared through their respective Advocates, as power has been filed on their behalf.
Earlier Renu Kumari had moved this Court in CWJC No. 8020 of 2011 seeking a prayer for implementation of the order passed by the appellate Tribunal in Case No.161 of 2010. As there was no challenge to the order passed by the Tribunal, this Court had directed to implement the order of the Appellate Authority without delay. After disposal of CWJC No. 8020 of 2011, Manju Kumari filed CWJC No. 13912 of 2015 challenging the ex parte award raising a grievance that she was not given notice to contest the case and this Court accepted the plea that has been taken by Manju Kumari in the aforesaid writ petition and set aside the order
Patna High Court C. REV. No.266 of 2014 (6) dt.04-02-2015 2/2 passed in Case No. 161 of 2010.
In view of the change d circumstances the order dated 15th May 2014 passed in CWJC No. 8020 of 2011 is withdrawn as the order passed by the appellate authority is now not in existence.
In such view of the matter, there is no need for any authority to implement the order passed by the appellate Tribunal in Case No. 161 of 2010.
With this direction this petition is allowed. Let the order passed in CWJC No. 13912 of 2014 be kept on the record.
