It is submitted on behalf of the petitioner that despite the order passed by the Licensing Authority-cum-Sub-divisional Officer, Areraj, East Champaran having been set aside by the appellate authority and matter having been remanded for fresh consideration on 12.09.2015, no order has been passed till date by the Licensing Authority.

Patna High Court CWJC No.19416 of 2016 dt.28-01-2017 In above view of the matter, this writ application is being disposed of with a direction to the Licensing Authority to take a decision on its own merit and in accordance with law within a period of two months from the date of receipt/production of a copy of this order. While doing so, he should also consider the observations and direction given by the appellate authority and follow the procedure which has been laid down in the statute concerned.
