JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-11-2017 Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in connection with Asthawan P.S. Case no. 131 of 2017 registered for the offence punishable under Sections 384, 385, 427/34 of the Indian Penal Code.
The petitioner and one other accused are said to have taken Rs. 100/- per tractor for lifting the sand from the bank of Jirain river thereby causing damage to the embankment of the river.
It is submitted by the learned counsel for the petitioner that no one has made any complain against the
Patna High Court Cr.Misc. No.53954 of 2017 (2) dt.13-11-2017 petitioner regarding taking of alleged money from him. As a matter of fact, the informant has falsely implicated the petitioner in this case as Asthawan P.S. Case no. 120 of 2017 under Section 307 and other allied Sections of the IPC has been filed against informant and others. The allegation levelled against the petitioner is not specific rather omnibus. The petitioner has been languishing in custody since 01.09.2017. Similarly situated coaccused namely, Sunil Kumar has been enlarged on anticipatory bail by a co-ordinate Bench of this Court vide order dated 17.10.2017 passed in Cr. Misc. no. 45444 of 2017. Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.MV, Nalanda at Biharsharif in connection with Asthawan P.S. Case no. 131 of 2017.
