The petitioner seeks bail in connection with Jamalpur P.S. Case No. 109 of 2016 dated 28.08.2016 instituted for the offences under Sections 120(B), 326 and 307 of the Indian Penal Code and Sections 3/4 of the Explosive Substances Act. A bomb was hurled in front of the house of the informant but without causing any damage to the property or injuries to any person. Another live bomb was also found near the house of the informant.

It has been alleged in the FIR that one of the cousins of the informant viz. Saurabh Kumar, who too has been made accused in this case, had conspired with the petitioner for forcing the informant from vacating his place of residence. The name of

Patna High Court Cr.Misc. No.53345 of 2017 (3) dt.06-12-2017 the petitioner has been taken in the FIR on the basis of information provided to the informant by another cousin of his viz. Raushan Kumar.

The petitioner is accused in about five cases. Learned counsel for the petitioner, however submits that out of aforesaid five cases, he has been acquitted in three of them, whereas he is on bail in the other two.

Taking into account the fact that the petitioner is in custody since 30.07.2017 and nature of accusation levelled against him, this Court is inclined to grant bail to him. In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Jamalpur P.S. Case No. 109 of 2016.
