In the present case, the petitioner is claiming that he was allotted the work by the Executive Engineer, Building Construction Department for cutting and purning of trees under Garden Division, Patna for they year 2014-15, which is apparently clear from Annexure-1 (series) and the statement made in paragraph No.5 of this writ application.

Learned counsel for the petitioner submits that though the petitioner has completed the work, but has not been paid any amount.

In such view of the matter, let the Executive Officer, Garden Division, Building Construction Department, Patna examine the claim of the petitioner. For convenience, the petitioner is directed to file a detailed representation before the Executive Officer, Garden Division, Building Construction Department, Patna. If such a representation is filed by the petitioner, the Executive Officer will be obliged to decide the same in accordance within law. If it is found that the petitioner has carried out the work, then the amount which the petitioner is entitled to, will be paid to him without unnecessary delay. The entire exercise will be completed by the Executive Officer within a period of three months from the date of filing of representation by the petitioner. 5.

With the aforesaid observations and directions, this writ application is disposed of.
